Hi David, I received a partial response from Apress.  They are ok with
us providing the source code subject to an open source license.  If we
do so, we would certainly have the right to use the code elsewhere.  
Also, we have reprint rights and up to 10% of the book at a time, and no
more than 30% of the whole, which should also be sufficient since Chris
confirmed that the amount of code is minimal.

The only major issue left is Sun taking back the rights to the book if
Apress does not promote/distribute the book widely.  This is largely a
business issue, with Apress agreeing to allow Sun to publish on the
topic, subject to the restrictions and exceptions I discussed above.  
Please let me know if the BU is ok with the exception as described in
section 2 of my last email if Apress is unwilling to provide for a
reversion of our rights to this particular book under our terms.  The
key import may be an argument by Apress to limit our ability to publish
a short e-book similar to the one here.  Most other circumstances seem
to be excepted as non-competitive under the drafted language.
