Anyone who believes (s)he may have experienced improper scrutinization in regards to their legitimate use of Sick Time either for their own, personal needs or the needs of a family member is encouraged to contact the OPEIU Local 30 office, (619) 640-4840 and/or Kaiser Permanente Human Resources.  Due to a recent incident which is being looked into would be helpful for both OPEIU Local 30 and Kaiser Permanente Human Resources to be made aware of any other concerns in regards to this issue.  

Please refer to the Agreement between OPEIU Local 30 and Kaiser Permanente in regards to the proper uses for Sick Leave (and all other legitimate leaves of absence), the California Employment Sick Leave Act (AB 109) which Governor Davis signed on July 23, 1999. Effective January 1, 2000, an employer who provides sick leave to its employees will be required to permit such employees to use half of their accrued sick leave to attend to the illness of a child, parent, or spouse, of the employee. AB 109 prohibits discrimination in any manner against an employee who uses, or attempts to exercise, the right to use accrued sick leave to attend to a child, parent, or spouse of the employee who is ill. An employee aggrieved by a violation of this statute will be entitled to reinstatement and the greater of actual damages or one day's pay as well as appropriate equitable relief. This statute does not extend the maximum period of leave permitted by the FMLA or the California Family Rights Act.  Additionally, please refer to the Family Medical Leave Act which provides eligible Employees up to a total of 12 workweeks of unpaid leave during any 12-month period.
