Appeal disposed off by Information commissioner whereas the PIO himself admit that the information has not been provided.

कार को निर्धारित फीस जमा करवाने के लिए लिखा गया पर निर्धारित फीस जमा ना करवाने
कारण ही अभी तक फ़ोटो-कापीयं उपल्ब्ध नहिं करवाई जा सकिं!
My Comments: The PIO has not replied within 30
days, the stipulated time. The reply had been received after 40 days of
application. So, due to non reply of the application the request had been made
to FAA and SIC that the information kindly be provided free of cost as per Sec
7(6) of RTI Act.
8.   विनय कार को दफ्तर बुलाया गया पर वह हाजिर नहिं हुआ1 इस
कारण सूचना उपलब्ध नहिं करवाई जा सकी!
My comments: On repeated requests the PIO failed to
provide the documents. The complainant reported to the notice of FAA and in the
order of FAA it has been written that appellant has reported to the office.

9.   लड़ी नं: 9 से 15 तक सूचना विनयकार द्वारा सड़्कों का विवरण ना देने कारण ही
उपलब्ध नहीं करवाई जा सकी जी!
My comments: When in the RTI application it is
specified everything. The PIO is making this or that excuse.

और 17 की सूचना इस कारण उप्लब्ध नहिं करई जा सकी क्योंकि विनय कार द्वारा मांग करने
पर दी गई तिथी और समय पर विनयकार ख़ुद दफतर हाजिर नहिं हुआ!
My comments: The lette received on 18th oct 2009 to
report on 21st Oct 2009. The complaint replied by Registered Post on 19th Oct
2009 that the documents pertaining to inspection has not been delivered so far.
So, the inspection can not be done. Kindly submit the documents at the earliest.
The Registered letter has been sent because in Muncipal Council Dak Receipt
section no body give acknowledgement of the receipt of the dak.

My comments: In the application everything is
mentioned which documents are requiered. The PIO's query is baseless.

On 27th Oct 2009 there was the hearing in the court
of S. Surinder Singh Information Commissioner. The PIO submitted the above
mentioned reply in the court of the SIC, He was not delivering the copy of this
letter, on my repeated assistance I requested to the IC to deliver the copy of
the letter submitted by PIO then the Commissioner agreed and asked the PIO to
deliver me the copy. He was reluctant to give that copy and was saying that Sir,
it is for SIC the complainant has no right to receive the copy of my reply.
Anyhow with my pleadings I got that .  The Points to be noted.
When I submitted the reply made by the PIO to the
SIC and pleaded that the PIO is asking which information is required by you. The
IC don't listen to my pleadings and turned to PIO.
PIO said that the complainant had called in the
office to get the inspection done. But he did not report. On that point the IC
kept on shouting at me that when you have confirmed the dates like 7th Oct, 14th
Oct and 21st Oct then why don't you go to the office to conduct inspection. When
I tried to specify my point he did not listen to my clarification and again
shouted Stop it. It's all and he directed the case should be disposed off.
Information Commissioner said there is no such provision of inspection in RTI.
No need to do inspection,
Information commissioner directed me to get the
sample at your own. Call the concerned officials for sealing of the sample and
get it tested from the laboratory at your expense.
The Information commissioner did not hear and
disposed off the case without providing informations while shouting.

My clarifications are as under:
2.1   On 18th Oct 2009 I received the letter from
Public Information Officer to come to the office on 21st Oct 2009 to get the
samples of the roads. The same day i.e. on 18th Oct 2009 the complainant written
letter to the PIO and posted on 19th oct 2009 vide Registered letter through
Post Master Phagwara that as per my request you have not delivered the documents
pertaining to the inspection. So, kindly deliver the documents regarding tender
documents, work orders and the tender passed from this place to that place the
inspection could not be made. But the Information commissioner did not listen to
my pleadings and keep on saying that the case should be disposed off.

3.   While shouting the Commissioner said in the
court that Do you need the documents pertaining to one contractor or all of the
contractors of Phagwara municipal council.
   3.1.   I said the contactor of Nehru Nagar ward.

   3.2.   Then again the
Commissioner shouted and said that the contractor might have not done your work.
So, that you are demanding the information with regard to that contractor.

My comments:
   1  I don't know who has
done the developement works of Nehru Nagar Ward.
    2. In my whole life I have never
met with not this contractor but not a single contractor of Phagwara Muncipal
Council. I don't know who are the contractors of Phagwara Muncipal
Council.
   3.   What type of work the
contractor had not done for me which the commissioner shouted. I am only the
resident of Nehru Nagar locality. The road has been laid down by the concerned
labour. I have not met contractor or the concerned labour during and after the
works even.
   4.   The PIO seconded the version
of Commissioner that the Contractor has not done his job. Yes it is correct
version.

I said whatever the problems I am facing I
have made complaints about the leakage from the house of neigbour. Due to the
floor trap leakage we have made several complaints to you under Speed post but
no action has been taken.
He said we will solve this problem. We will
inspect the location and will serve notice to the opposite party. He will get
the job done.
I said this is my constitutional right to
get information. I m not getting any favour from you.

Last time when I visited Muncipal council
office. Then the Muncipal Engineer said. Madhok ji, you complain to the
President of India. The application is being marked from her office. Come to the
Peon of Muncipal Council and like wise return to President. What is the fun to
write to president. Whether any job can be done with the intervention of
President.

(State appointments) ke hote hain aur in ki badliyan hoti rahti hain. Is samein

Nagar council ki ijajat ke
bina in kamo ki inspection nahin karwayi ja sakti.
The roads are
totally broken these days. Please give specific reasons for the bad condition of
each of these roads separately.

If it is due to
clogged drain, please provide the following information from the concerned
department which dealt with it:
Dates when these drains were cleaned during the stated
period.
Give copy of the measurement book of the cleaning
carried out.
Provide the names of the officials who inspected and
passed the payments.
This means that these officials did not do their job
properly. Their inaction has caused so much loss to the exchequer and much
inconvenience to the public. They are also guilty of criminal misconduct under
section 13(1)(d) of the Prevention of corruption Act. Please state what action
is due against them.

roads have broken shows that very bad material has been used in the
roads.

the quality of the roads.

fixed.
Please state the date of start and date of completion of
each enquiry.

to have been made fraudulently and the inspection carried out by the engineers
was faulty. Please state what enquiries are due to against the engineers who
passed the payments and did faulty inspection.

choice under section 2(j)(iii) of the Right to Information Act, 2005. The
samples should be collected in my presence and should be sealed and certified.

who I should meet to start the exercise.

restored to their original conditions by the date indicated in Item 19 above,
what action will be taken AND what penalties will be levied by Council against
the officers/ contractors/ agencies which do not restore the road on
time?

Sir,
In Punjab when we file application in English language the reply received is in Punjabi language and on the date of second hearing we have to provide the evidence of RTI application to SIC once in English and Punjabi language. It is a very tedious matter which can not be solved. Rather the IC don't listen to the pleadings of the information seeker that as per RTI it is manadatory to reply in the language in which the information has been sought.

Reference: In the subject matter as per your order dated 14-09-2009
   As per the subject  cited above and with regard to applicant's  request on twenty points information sought, the request is made as under:-
1.   Information has been provided.
2.   Information has been provided.
3.   Information has been provided. The inspection report is not available.
4.   Information has been provided.

7.   The applicant had been written to deposit the requisite fees, for not providing requisite fees the information has not been provided.
My Comments: The PIO has not replied within 30 days, the stipulated time. The reply had been received after 40 days of application. So, due to non reply of the application the request had been made to FAA and SIC that the information kindly be provided free of cost as per Sec 7(6) of RTI Act.
8.   The applicant had been called to the office but he has not reported. So, the information could not be provided.
My comments: On repeated requests the PIO failed to provide the documents. The complainant reported to the notice of FAA and in the order of First appellate authority it is clearly mentioned that appellant has reported to the office on the notice served to report on specific date.
9.   From Sr. No. 9 to 15 as the applicant has not provided the details about the roads so the information has not been provided.
My comments: When in the RTI application it is specified everything. The PIO is making this or that excuse.
10.  Regarding Point 16 & 17 the information could not be provided that as per the demand the applicant has not reported in the office on the specific date and time.
My comments: The letter received on 18th oct 2009 in the evening by hand delivered by the peon of Municipal Council, the contents of the letter was the applicant is directed to report in the office on 21st Oct 2009 at 10 AM Sharp. The appellant  replied by Registered Post on 19th Oct 2009 that the documents pertaining to inspection has not been delivered so far to me. So, the inspection can not be done without the knowledge about the contents of inspection.  Kindly submit the documents at the earliest. The Registered letter has been sent because in Muncipal Council Dak Receipt section no body give acknowledgement of the receipt of the dak/ Post.
11.   Despite writing time and again to the applicant. the applicant has not specified that he requires copies of the despatch register pertaining to which year and which month.

Sir,
In Punjab when we file application in English language the reply received is in Punjabi language and on the date of second hearing we have to provide the evidence of RTI application to SIC once in English and Punjabi language. It is a very tedious matter which can not be solved. Rather the IC don't listen to the pleadings of the information seeker that as per RTI it is manadatory to reply in the language in which the information has been sought.
