Hi group,
Avi Romano that has contributed with iPhone patches to RoadMap
informed me about half a year ago that the Freemap project has changed
it's name to 'Waze'.
Now Waze is available for the iPhone, which is great (only works in
the US for now) - but I can't find any link to the GPL text or the
waze client source code on the website. (and since the source code
can't really be delivered along with the binary in the App Store I
assume that it must be made available on the related website).

It appears they are using the proprietary back-end that Ehud Shabtai
made for Freemap Israel - at least it's the same functionality that
Freemap Israel also provided (clients help build the map).

I asked on the blog if they are indeed the same 'Waze' that is a fork
of Roadmap - and if so to provide source code.

http://www.waze.com/about/team/

Can any on this list help with this? Avi or Ehud, maybe you are
following this thread too?

Sincerely,
/morten

does the iPhone binary package not make prominent the fact that
the code is GPL'ed?  if the Waze app is in compliance, you should
not be having any issue at all finding the source.  if you can't
find the source, then the package isn't in compliance.

Hi Paul,
Yeah, that's my only problem - the program is currently only available
on the US app store - which I don't have access too.
And as such I of course know that I myself is not entitled to receive
a copy of the source code, but the US customers may be (if indeed this
is the same Waze, but I'd say it appears to be).

But if they have a clear indication that it is GPL v2 and do have a
pointer to the source code they have not chosen to use their main
website to distribute it.

Hopefully I can find a way to try out the app 'cause altogether I
naturally think that it's great that the code gets spread as widely as
possible!

Sincerely,
/morten

Hi Morten,
I downloaded it and could send it to you if you would like - I assume you
are still jailbroken, so shouldn't be a problem for you to "install" it.
It's free, so I don't think I would be engaging in anything evil here
(except perhaps in Apple's eyes, which I could care less about) - correct
me if I'm wrong.

I haven't had much of a chance to use it and so have no real opinion on it,
other than it has a very cartoonish feel to it - seems marketed to kids.
I'll probably check it out in the next couple days.

Hi Joshua,

I'd love to see the app if you'd send a zipped version! Just to find
out if my assumptions about the origin of the app are correct.

Thanks a bunch!
Sincerely,
/morten

hi josh --

how is the GPL "availability of source" requirement handled?

Hi Paul,
Don't know - I haven't found it yet, certainly not handled in the GUI app
that I have seen and the website (www.waze.com) doesn't clearly provide it
either.

see: http://www.waze.com/legal/english/TOS.html
"
The Waze client is based on GPL open source code. If you use any part of
the Waze client skin (including the graphics or sound files) you must use
it together with the Waze map and map data, and You may not include maps or
map data from any other party without our advance, written consent.  If You
use the Waze client, together with the Waze map and map data as permitted
above, You may also our server APIs and real time data without our prior
written consent.
"

I haven't found any downloadable source code, so it does seem to be in
violation (but maybe it's in the filesystem of the iphone.... I haven't
looked there yet (also not sure if that would really count as "available"
to the general user population, as you would need to jailbreak to see it
(which may or may not violate DMCA.....))).

It is definitely derived from Ehud's work on freemap israel according to
their "about" page.

Regards,
Josh

Hi group,

Thanks for the comments - I just wanted to bring this up so that you
know it's out there!
Of course any violations need to get fixed - and I'm sure that they
will eventually. Probably a lot to get around to when releasing such
an app...

But altogether I think it's really great that the app is out there -
and every contributor should be proud.

Since I am not (yet) a customer I am reminding myself that _I_ don't
currently have any claims to the modified source as stated by the
GPL...

That being said I am of course curious to have a look at the code! ;-)
And hope that some of the changes have value together with other data
sources such as OSM.

Sincerely,
/morten

Please remember that we've seen incomplete "evidence" at best.

There's also a support email address that we can try for the source.  I
just haven't gotten to that yet.

Hi there,
I've written a small reminder (very politely indeed ;-) and I am
awaiting an answer. I completely agree with you, Danny, there's no
reason to think that anyone is intentionally holding anything back -
I'm certain that they've just not gotten around to it.

Sincerely,
/morten

re-reading this, it sort of depends on what they mean by "the Waze
client skin".  if the skin is really separable, and separately licensed,
then i guess it's okay if they say you can only use the skin with their
map data.

i have a friend with an android phone who's going to install it so
i can take a look.

That they don't have the source available on their site doesn't make
them in violation of the GPL. They just have to provide "reasonable"
access to it. E.g. pay a few dollars to get a CD, or receive it via
email if you request it).

yes, but they have to make that offer explicitly and obviously.
